Michigan Earned Sick Time Act: What Employers Need to Know

Michigan’s Earned Sick Time Act now affects almost every employer in the state. This short video gives employers a quick look at the rules and a reminder to check their policies.

What this video covers

  • The Act took effect February 21, 2025, replacing the Paid Medical Leave Act
  • It covers nearly all employees, including part-time, temporary, and seasonal workers
  • Employees accrue one hour of sick time for every 30 hours worked
  • Employers may instead front-load 72 hours (11 or more employees) or 40 hours (10 or fewer)
  • Policies, handbooks, and payroll systems may need updates

Are your sick time policies ready for the Earned Sick Time Act?

The companion article explains that the Act came about after the Michigan Supreme Court ruled in 2024 that the legislature’s amendments to the original 2018 voter initiative were unconstitutional. Unlike the old law, which exempted many small businesses and part-time workers, it reaches almost everyone who works in the state. Only a few exceptions remain, such as unpaid interns, employees under 18, and federal government workers.

Employers may require reasonable notice for foreseeable absences and may ask for documentation after more than three consecutive days off. They may also set a waiting period of up to 120 calendar days before new employees can use their time. Sick time must be paid at the employee’s regular rate or the state minimum wage, whichever is greater.
