Michigan’s Intimate Deepfake Law (HB 4047/4048): What Employers and Platforms Should Know

Michigan’s new law on intimate deepfakes, House Bills 4047 and 4048, took effect on August 26, 2025. This video explains what the law does and what it means for employers and online platforms.

What this video covers

  • What counts as an “intimate deepfake” under the law
  • Civil lawsuits against creators and people who knowingly share the content
  • Criminal penalties, which can rise to felonies in aggravated cases
  • Policy, training, and reporting steps for employers
  • What platforms that host user content should put in place

Why does Michigan’s deepfake law matter to employers and platforms?

According to the companion article, the law covers media created or altered by technical means so that a reasonable person would believe it shows a real, identifiable person in an intimate context. It reaches not only the person who creates the content but also anyone who knowingly spreads it without consent. A person who is depicted can sue for an injunction to stop distribution and for money damages, and the law also creates criminal penalties.

For employers, the article recommends updating anti-harassment, social media, and acceptable-use policies so they clearly cover AI-generated sexual content, explain how to report it, and describe the discipline that can follow. Platforms that host user content should offer a clear, well-publicized reporting channel and a time-bound process for reviewing claims.
