Litigation is the process of taking legal action. Litigation refers to a case which is or may be proceeding through the traditional court process, and not through alternative dispute resolution, such as mediation or arbitration. A litigator is a lawyer who litigates; that is, assists clients with prosecuting or defending lawsuits. Some litigators will appear in court and go to trial but much of the work of litigation occurs outside of trial. A civil lawsuit is a legal dispute that does not involve a crime, usually involves money and is brought before a court of law. Litigation commences when a lawsuit is formally filed. This process evolved over the centuries and involves determining issues through a court, with a judge or jury. Conversely, arbitration involves an agreement between parties to submit their dispute to a disinterred third party who will decide the merits of the case.
